  • Transparency in public procurement is guaranteed through the timely publication of all information related to contracts signed by state entities, so that it is known to the public. The main means of publication is the Electronic Public Procurement System (SECOP), in which all state contracts, specifications, and each of the documents issued within the procurement processes must be published no later than three days after the issuance of each document. Similarly, contracting in a transparent manner implies that state entities select contractors objectively, verifying that they are truly qualified to execute the contracts, applying current regulations and avoiding favoritism. Within the framework of Ruling T-302 of 2017, this principle ensures that the contractual processes related to its compliance are carried out with accessible information and substantiated decisions, so that it is possible to identify how each contract contributes to complying with the orders of the Constitutional Court.

  • This indicator measures what percentage of the total number of contracts entered into is directly associated with the ruling. It does not measure money, but rather the number of processes. n For example, if the figure is 11.34%, this means that just over 1 in 10 contracts signed by the State Entity are linked to compliance with Ruling T-302. In addition, it allows us to identify the level of participation of these processes in contract management and to show how integrated the actions associated with the ruling are in institutional planning and contract development, in compliance with the principles of transparency and planning that govern public procurement.

  • Objective selection of contractors means that public entities must choose suppliers based on clear facts and rules, not personal preferences. Bids are compared using criteria defined from the outset—such as quality, price, and compliance—to choose the option that is truly best for the government. This prevents favoritism, promotes competition, and ensures that public money is used well and fairly for everyone. In some cases, this objective selection is guaranteed through competitive selection methods, characterized by the participation of several bidders, such as public bidding, abbreviated selection, minimum amount, and merit-based competition. In other cases, the contractor is chosen directly, without competition between bids, as in the case of service contracts, as well as those signed with duly recognized indigenous authorities and organizations. Both types of contracting are permitted, provided they are carried out in cases allowed by law. In the context of Ruling T-302 of 2017, objective selection ensures that contractual processes related to its compliance are decided based on verifiable criteria and previously established rules, ensuring that contracts associated with Constitutional Court orders respond to real needs and the demonstrated capacity of contractors.

  • This indicator shows what part of the procurement records published by State Entities in SECOP has been identified with the T-302 Ruling marker, which is used to indicate the contractual processes that each entity links to compliance with said Ruling. n This indicator shows the proportion of processes that entities recognize as related to the actions necessary to comply with the orders issued by the Constitutional Court in the ruling.

  • This indicator shows what proportion of the money contracted by the State Entity is directly related to compliance with Ruling T-302 of 2017. For example, a value of 32.26% means that of all the money contracted by the State Entity, about one-third was allocated to actions related to the Ruling. n Depending on the percentage, it reflects whether the entity is financially prioritizing the obligations arising from Ruling T-302 and clearly directing its resources to advance compliance with the orders issued by the Constitutional Court.

  • This indicator identifies the proportion of contractual processes associated with compliance with Ruling T-302 that are carried out through competitive selection modalities, which allow the participation of several bidders and the comparison of proposals. The indicator shows how the selection modalities used in contracting related to Ruling T-302 are distributed, distinguishing between processes carried out through competitive schemes and those carried out through direct contracting, in accordance with the modalities established in current regulations. This indicator does not include information corresponding to the Special Procurement Regime, which covers, among others, contracts entered into by recognized indigenous authorities and organizations, as well as other modalities not subject to the General Procurement Statute. These processes are carried out under their own rules and are governed by provisions that differ from the competitive and direct selection modalities of the General Public Procurement Statute.
